Adverse possession

It is possible to be in adverse possession of property through illegal structures (Wan Hok Taoist Association v Nos 88 – 90 Pan Hoi Street (IO)).

Building Management Ordinance: repair

The repairing obligation in section 18 of the Building Management Ordinance is one of proper management and requires the incorporated owners to do all that is reasonably required in the circumstances (顏小明v 多福大厦業主立案法團).

Leases: forfeiture: surrender: derivative interests

Forfeiture of a lease also brings sub-leases and other derivative interests to an end. Surrender does not have this effect (Great Western Railway Company v Smith).
