A long-delayed completion

In Pang Chi Yeung v Lau Yuk Choi ([2011] HKEC 1666) P entered into an agreement with A in 1997. Under the agreement, P was to buy land from A. He agreed to make payments for the land, for the construction of a Small House and to make a final payment when the Certificate of Compliance of the Small House was issued. P made the payments due to A under the agreement. He moved into the house in 2004. In the same year the Certificate of Compliance was issued but P only discovered this in 2007. A disappeared without conveying the land to P. It transpired that the true owner of the land was L and he had entered into an agreement to sell the land to A. The Court made an order for the title to the land to be transferred to P.
