Blocking access to car park

Lung Po Kwan v Tang Kam Sheung ([2011] HKEC 451, CA) concerned a dispute between the owners of neighbouring car parks. The owner of one of them parked her van partly on a passageway forming part of the common parts of the development. As a result, the owners of the neighbouring space were unable to access their space. The owners of the neighbouring space were granted an injunction to restrain the parking of the van in such a way as to obstruct access to their space. They were also awarded damages.
